Citing case complexity, UKIPO bows out of patent inventorship dispute

( December 4, 2024, 10:10 GMT | Official Statement) -- MLex Summary: The UK Intellectual Property Office has said a bid for correction of inventorship — filed by the University of Southampton and Professor James Scanlan of a UK patent assigned to Windracers Ltd — should be decided by the High Court. Windracers had filed a declaratory judgment action there in July. UKIPO deputy director Ben Micklewright — citing the “significant fact-finding” required and “non-patent law questions” presented in the case — exercised the office’s discretion under Luxim v Ceravision, as interpreted in NGPOD Global v Aspirate N Go, in granting Windracers’ “decline to deal” request.See attached document....
