UK panel assigned to Tesla appeal says fast ruling unlikely in Frand dispute

By Melissa Ritti ( December 3, 2024, 21:13 GMT | Insight) -- A two-day hearing in London concluded today as expected, with no ruling by the UK Court of Appeal on Tesla's bid to reinstate its request for a declaration of fair, reasonable and nondiscriminatory terms to a global license for the Avanci 5G patent pool. Consensus was hard to come by, with the parties — including patent owner InterDigital Technology — disagreeing on a litany of issues, especially whether the Delaware Court of Chancery would be a better forum for the dispute.The question of Tesla’s ability to maintain a freestanding claim for a declaration of fair, reasonable and nondiscriminatory (Frand) terms for a global license to Avanci’s collection of 5G standard essential patents, or SEPs, is now in the hands of the UK Court of Appeal....
