Amex fails to get US antitrust case over non-discrimination rules moved to arbitration

( December 2, 2024, 15:46 GMT | Official Statement) -- MLex Summary: American Express was denied a motion to compel arbitration in a US case challenging its non-discrimination provisions. US District Judge Mary S. McElroy said that previous American Arbitration Association demands sought a broad injunction under federal antitrust law, and the current complaint does too. “There are differences, but those differences do not ‘fundamentally change the ‘scope or theory of the [merchants’] claims’ to have revived’ Amex’s right to arbitrate.” McElroy also refused to strike plaintiffs’ class claims, finding that Amex has not shown that the request for declaratory relief must, at such an early point in the litigation, be taken off the table.See attached file. ...
