OpenAI discovery requests of New York Times rejected for lack of relevance

In her ruling, US Magistrate Judge Ona T. Wang of the Southern District of New York said that OpenAI's rationale — that the NYT invited the scrutiny by claiming in its amended copyright infringement complaint that "the mere existence" of artificial intelligence "is a threat to its business model and the enterprise of journalism" — fails for multiple reasons. Not only was the statement made within a heading in the complaint, and not as a claim or a defense, but the discovery request lacks any relevance to OpenAI's attempt to shield itself from liability under the doctrine of fair use, Wang concluded.
