Repairify files reply brief against US antitrust claims over remote vehicle diagnostics

( November 22, 2024, 23:31 GMT | Official Statement) -- MLex Summary: Repairify filed a reply in support of its motion to dismiss US antitrust claims filed by Elitek Vehicle Services, saying that they were compulsory or permissive counterclaims in an earlier Texas action. “Elitek makes a different counterargument for Counts I-II vs. Counts III-V. Elitek says an exception in Fifth Circuit law applies to Counts I-II but then argues an exception in Seventh Circuit law applies to Counts III-V. This is incoherent, and Elitek cites no case of a federal court simultaneously applying two different circuit laws to a procedural question.
