Australian state court sets limits on AI use by lawyers, judges

In a practice note issued this week, the Supreme Court of New South Wales said generative AI could not be used to generate the content of material intended to reflect the evidence of witnesses, including affidavits, witness statements and character references. The guidance includes a general prohibition on feeding suppressed and confidential material into large language models, as well as more specific rules against experts using it to create reports and judges using it to draft reasons.The Australian legal profession’s rapid adoption of generative artificial-intelligence tools has hit a speed bump, after a key state court warned lawyers and judges against particular uses of the technology....
