EU General Court upholds validity of lighting box community design, dismissing Lidl Digital's appeal

( November 20, 2024, 11:37 GMT | Official Statement) -- MLex Summary: The EU General Court dismissed Lidl Digital International's appeal against the decision of the Board of Appeal of the EUIPO declaring the contested lighting box design to have individual character. E-commerce services provider Lidl had challenged the validity of the community design registered in 2018 by Ningbo Hanyuan Lighting Co., alleging priority of an earlier Chinese application. The Cancellation Division of the EUIPO rejected Lidl's invalidity claim in 2022, and the Board of Appeal later dismissed Lidl's appeal. The court also issued a separate judgment dismissing Lidl's appeal regarding the disclosure of the prior design and proof. The decisions are attached in French.
