Netgear asks US judge to hold 'mini-trial' on RAND issues in SEP dispute with Huawei
( November 15, 2024, 16:00 GMT | Official Statement) -- MLex Summary: Netgear asked a California federal judge to bifurcate its dispute with Huawei Technologies and set an early trial to determine appropriate worldwide reasonable and non-discriminatory terms for Huawei’s Wi-Fi standard essential patents, or SEPs. In a memorandum in support of its motion to bifurcate, Netgear argued that "Huawei has engaged in a scorched earth worldwide litigation campaign utilizing the threat of injunctive relief in an effort to bludgeon Netgear into accepting a license with unreasonable and discriminatory terms." Huawei has Netgear "in the stranglehold of a patent holdup and is attempting to extract royalty rates that do not reflect the value of its patents," Netgear further asserted. Netgear said that bifurcating "the discrete issue of determining Huawei’s contractual obligation to provide Netgear with a worldwide license will expedite and economize this action to the convenience of the Court and the parties."See court documents. ...
