Zhejiang Sunflower, Sunowe Solar lose appeal of retroactive duties at EU court

( November 20, 2024, 09:59 GMT | Official Statement) -- MLex Summary: Chinese solar-panel maker Zhejiang Sunflower Light Energy Science & Technology and EU importer Sunowe Solar today lost their challenge of the EU Commission's withdrawal of a minimum price agreement that allowed for avoiding tariffs at EU borders. The regulator retroactively billed the manufacturer due to breaching an undertaking to sell above a certain price floor. The EU's first-tier court fully rejected the appeal, finding that the EU watchdog was right to determine that all transactions and invoices relating to solar modules re-sold by Zhejiang Sunflower via its related importer were affected by foul play, irrespective of whether a re-sale to an independent customer in the bloc took place.The judgment is attached.
