California iPhone buyer asks US judge to deny federal jurisdiction in Apple 'walled garden' case

( November 14, 2024, 17:24 GMT | Official Statement) -- MLex Summary: Counsel for California iPhone buyer Kyle Whiteside asked a New Jersey federal judge to reject Apple's arguments claiming federal jurisdiction and remand its California state law case over Apple's "walled garden" device ecosystem to a Santa Clara county court. Because the proposed plaintiff class has only alleged violations of California's Cartwright Act and Unfair Competition Law, the case doesn't raise federal issues, the motion-to-remand filed to the US District of New Jersey said. As masters of their claim, plaintiffs can avoid federal jurisdiction by reliance on state law, the filing said. See attached document:...
