Philips granted partial reimbursement of court fees for interim measures withdrawal at UPC

( November 15, 2024, 11:20 GMT | Official Statement) -- MLex Summary: The Unified Patent Court Local Chamber Munich granted Dutch technology company Philips' request to reimburse 60 percent of the court fees it paid in proceedings concerning its September application for interim measures against Shenzhen Yunding Information Technology Co., Ltd. This application was withdrawn the following day and Philips sought reimbursement of some of the court fees it had paid. The court concluded that the reduced court workload and encouraging early resolution justified the analogous application of Rule 370(9)(b)(i) of the UPC Rules of Procedure which governs fee reimbursement upon withdrawal of an action.See court document attached....
