Rejection of remittitur could come back to haunt patent owner during retrial

A jury in March awarded GeigTech more than ten times the amount it requested, leading the court to offer a choice: remittitur or try the issue of damages again. GeigTech elected the latter, and earlier this week, was sanctioned in connection with a botched attempt to change its damages theory at the eleventh hour.A “secret plan” by a patent owner to recapture a windfall verdict rendered in March by scrapping its prior damages theory and presenting new testimony at a retrial next week have landed with a thud....
