Curative instruction sought by Insulet in US trade secret trial with EOFlow

By Melissa Ritti ( November 12, 2024, 17:10 GMT | Insight) -- A jury will reconvene today in Massachusetts as trial continues over allegations EOFlow misappropriated Insulet trade secrets directed to the design of the “Omnipod” insulin patch pump. Whether jurors will be instructed that companies are under no statutory obligation to catalog their inventory of trade secrets remains to be seen, but a note sent to a US judge last week suggests — at the very least — there is confusion on the issue.In a memorandum filed yesterday Insulet urged a US judge to issue a curative instruction to jurors that the Defend Trade Secrets Act has no requirement that trade secrets must be labeled and logged as such, internally, in order to remain protectable....
