UK Supreme Court poised to clarify bad faith standard for trademark registrations

By Melissa Ritti ( November 12, 2024, 15:17 GMT | Insight) -- The long-awaited judgment in a long-running trademark dispute between SkyKick and Sky over mass registrations by the latter will be released tomorrow by the UK Supreme Court. SkyKick seeks a reversal of a 2021 appellate ruling which rejected findings that Sky’s conduct qualifies as bad faith under Section 3(6) of the Trade Marks Act of 1994.Trademark practitioners in the UK will soon get clarity on whether the practice of seeking registrations in classes a registrant does not use constitutes bad faith to such an extent those trademarks can be deemed invalid and unenforceable....
