Texas patent case against Wyndham won't be stayed, US judge rules

( November 8, 2024, 10:10 GMT | Official Statement) -- MLex Summary: A bid by Wyndham Hotels & Resorts to stay allegations it infringes five patents relating to software and functionality for mobile access to hotel rooms was rejected by US Judge Rodney Gilstrap of the US Eastern District of Texas.  In his ruling, the judge said Wyndham doesn't satisfy the factors for invoking the customer suit exception to the first-filed rule, and that the traditional factors for a stay also weigh against the hotel chain.  At issue are Liberty Access Technologies Licensing’s US Patent Nos. 9,373,205,10,657,747, 11,443,579, and 11,217,053 and 11,373,474.
