China unveils antitrust guidelines for standard-essential patents

( November 11, 2024, 04:40 GMT | Official Statement) -- MLex Summary: China's State Administration for Market Regulation has issued guidelines to strengthen regulations on the oversight of antitrust behavior involving on standard-essential patents, following a public consultation last June. The guidelines, which consist of six chapters and 22 articles, define SEP-related concepts and clarify the principles of antitrust analysis in this area. They are effective from Nov. 8.  In addition, they encourage SEP holders to engage in information disclosure, as well as fair, reasonable and non-discriminatory commitments, and "good faith negotiations" to better maintain a fair competitive order, according to the guidelines.The guidelines follow:...
