Properties of the Villages asks US appeals court to hold in abeyance noncompete suit against FTC

( November 7, 2024, 22:42 GMT | Official Statement) -- MLex Summary: Properties of the Villages has asked the Eleventh Circuit Court of Appeals to hold its case against the Federal Trade Commission in abeyance pending the disposition of the Fifth Circuit appeal in another case that also challenges the FTC's rule banning noncompete clauses in employee contracts nationwide. In a motion, Properties of the Villages said the outcome the Fifth Circuit appeal may render its own appeal moot or it may obviate the need for its appeal. "To conserve judicial resources, this Court should hold this narrower, interlocutory appeal of a preliminary injunction in abeyance pending the Fifth Circuit’s decision," the filing said. Before filing this motion, Properties of the Villages informed the FTC that it would be moving to hold the proceedings in abeyance. the FTC responded that it opposes the motion, the filing said.See attached document...
