W.L. Gore & Associates loses appeal over Cardioflow mark at EU court

( November 6, 2024, 11:01 GMT | Official Statement) -- MLex Summary: Medical products company W.L. Gore & Associates today lost its appeal at the EU’s first-tier court by which it sought to challenge an earlier decision by the EU Intellectual Property Office which found that specialized professionals would not fail to notice the important difference in the final parts of the existing mark Cardioform and the contested sign Cardioflow. In 2019, Angiokard sought to register an EU trade mark with EUIPO for the word sign Cardioflow, what W.L. Gore & Associates had opposed. In 2023, the EUIPO had concluded that a likelihood of confusion, including a likelihood of association, by a specialized public could be safely excluded. In a ruling delivered this morning, EU judges fully rejected the company's appeal, saying that the Board of Appeal was right in finding that there was no likelihood of confusion. The judgment is attached.
