In dismissing US infringement action against TikTok, judge sets high bar for copyright owners

Various holdings in the dismissal order by a US judge — including that plaintiff Elizabeth Waterman must show, and not merely plead, compliance with Section 512 of the Digital Millennium Copyright Act, as well as link the unauthorized display of her work to TikTok profits — leave little margin for error for rights holders whose takedown notices to the video sharing app go unanswered. TikTok has secured dismissal of copyright infringement claims leveled by a photographer whose work was displayed without authorization in social media posts she repeatedly requested be taken down pursuant to Section 512 of the Digital Millennium Copyright Act....
