'Extreme' conduct by former Prudential project manager warrants default sanction in trade secret row, US judge says

( November 1, 2024, 10:10 GMT | Official Statement) -- MLex Summary: A former project manager with Prudential Insurance Company of America who was mistakenly emailed Prudential trade secrets by a electronic discovery vendor must pay attorney fees and costs of $181,175 in connection with Prudential's efforts since May 2023 to secure her log-in and multifactor authentication credentials to Dropbox, Google Drive, and OneDrive. According to the US judge overseeing the case, Jennifer Kowalski “has engaged in willful noncompliance as well as dilatory tactics for over a year." In the same order, the judge said Prudential is entitled to an adverse inference that the emails by Epiq Systems contained Prudential trade secrets and were “accessed, retained, and misappropriated” by Kowalski.See attached document....
