Denial of attorney fee request in Strike 3 Holding copyright case upheld by US appellate court

By Nick Robertson ( October 30, 2024, 22:26 GMT | Insight) -- The US Court of Appeals for the Ninth Circuit ruled that a John Doe defendant isn't entitled to attorney fees after he settled a copyright infringement suit with prominent litigant Strike 3 Holdings, because neither party prevailed in the case within the meaning of Section 505 of the Copyright Act.  A special concurrence by Judge Sandra Ikuta said her fellow panel members need not engage in a detailed analysis of Doe's position, and that to do so is a waste of judicial resources. Strike 3 — one of the most prolific filers of copyright infringement lawsuits in the country — sued an unidentified John Doe defendant in 2021, claiming he pirated 27 of the company’s pornographic movies. Strike 3 has filed just under 16,000 copyright suits since 2009, according to a Lex Machina analysis....
