US judge says Astellas Pharma’s Myrbetriq patent not proven indefinite under heightened standard
By Melissa Ritti ( October 30, 2024, 20:22 GMT | Insight) -- Generic drugmakers Lupin and Zydus Pharmaceuticals suffered an early loss today in their bid to invalidate a patent associated with the bladder control drug Myrbetriq when a US judge in Delaware said they failed to prove indefiniteness by clear and convincing evidence. Plaintiff Astellas Pharma is not out of the woods yet, though. Lupin and Zydus will almost certainly renew their challenge on summary judgment and, if necessary, at trial.A US judge today issued an order construing three terms in an Astellas patent directed to a sustained release mirabegron formulation....
