Seagate tells US appeals court FTAIA does not bar US price-fixing claims over hard disk drive components

( October 29, 2024, 22:31 GMT | Official Statement) -- MLex Summary: Seagate Technology told a US appeals court that properly read, the Foreign Trade Antitrust Improvements Act does not bar it from pursuing damages for all of its allegedly price-fixed purchases of suspension assemblies from NHK Spring. Seagate asked the Court of Appeals for the Ninth Circuit to revive its claims. “[A]t a minimum, the FTAIA ensures that Seagate may recover for at least the substantial portion (33 percent) of its purchases bound for import into the US,” it argued.See attached file. ...
