Align Technology gets support from retired Federal Circuit judge on appeal of summary judgment in US antitrust case

Michel told an appeals court that the application of any antitrust framework must properly account for the exclusive right granted to innovators and inventors and how that exclusive right promotes consumer welfare and competition. Michel filed a brief in support of affirming a summary judgment in favor of Align Technology in an antitrust case over dental aligners. “The district court’s grant of summary judgment in favor of Align appears to reflect an accurate understanding of the procompetitive nature of the patent owner’s right to exclude, as well as the accepted understanding that refusal-to-deal claims cannot be allowed to trump patent rights, absent exceptional circumstances,” the brief said.See document below. ...
