Futurelink, IPValue tell US court that DOJ misapplies, ignores binding Ninth Circuit precedent in Realtek patent suit

( October 25, 2024, 22:32 GMT | Official Statement) -- MLex Summary: FutureLink and IPValue told a US judge that the US Department of Justice's arguments in a recent statement of interest contradict Realtek's complaint and conflict with binding Ninth Circuit precedent over the Noerr-Pennington doctrine. The DOJ rewrites RealTek's complaint, which challenges a "scheme" to impose meritless litigation costs on Realtek, to claim FutureLink and IPValue's pre-litigation offering of licensing agreements to Realtek removes Noerr-Pennington doctrine protections, the companies said in a response to the DOJ's statement. Even if Realtek's complaint had challenged FutureLink's licensing efforts in addition to its patent enforcement litigation, the DOJ's arguments "make no sense" because it never explains how offering Realtek a license prior to enforcing MediaTek's patents could possibly be coercive or anticompetitive, FutureLInk and IPValue said in their filing to the US District Court for the Northern District of California.See document below:...
