Fox, Disney, Warner JV 'exemption' undermines defense of bundling in US antitrust suit, Fubo says

( October 25, 2024, 23:52 GMT | Official Statement) -- MLex Summary: FuboTV told a New York federal judge that Fox, Disney and Warner Bros. undermine their own defense of their streaming packages, which bundle highly valuable sports channels with content "nobody watches," by planning a joint venture that will exempt consumers from those anticompetitive tying arrangements. "The harm that Defendants' bundling practices cause to competition and to consumers is especially clear in light of their planned JV, to which they plan to grant a unique exemption from their requirements," Fubo said in its brief opposing dismissal of its case. The defendants also fail to dispute Fubo's allegations over most-favored nation clauses in carriage agreements with YouTube TV and Hulu Live, and the suit should proceed so Fubo can obtain evidence of anticompetitive effect, the brief said.
