Amazon, US FTC debate whether depositions can be remote in monopolization case

( October 26, 2024, 00:07 GMT | Official Statement) -- MLex Summary: The US Federal Trade Commission and state attorneys general argued that in their case centering "on Amazon's coercive and punitive tactics against sellers, it is paramount" that a Washington federal judge "enter an order allowing third-party testimony to be collected in a manner that does not unnecessarily burden" witnesses.  In a joint submission with Amazon regarding remote depositions, the government plaintiffs said many of the third-party witnesses likely to be deposed "are independent business owners for whom the costs and burden of appearing in person may pose significant hardship." Meanwhile, Amazon asserted that cases like the FTC's "routinely entail nationwide depositions, and the standard practice is for parties to go to the witnesses to take their testimony." The e-commerce giant said the FTC and states "seek to secure a litigation advantage" with their proposal "to create a presumption that non-party depositions will proceed entirely by remote means."  See court document. ...
