Lenovo wins reinstatement of antisuit injunction bid days after UK hearing with Ericsson draws to a close

By Melissa Ritti ( October 25, 2024, 14:24 GMT | Comment) -- As a UK judge wrapped a hearing on a request by Lenovo for an interim license to Ericsson’s 5G standard essential patents this week, the US Court of Appeals for the Federal Circuit yesterday weighed in on the same dispute, directing a lower court to revisit Lenovo’s bid for an antisuit injunction that would halt enforcement actions by Ericsson in Brazil and Colombia. SEP owners must show compliance with their obligation to negotiate in good faith before pursuing relief based on their portfolios, US Circuit Judge Sharon Prost clarified. On remand, should Lenovo prevail in its request before a North Carolina federal judge, it could entice other SEP implementers to pursue antisuit injunctions in US courts.Ericsson suffered a setback yesterday when the US Court of Appeals for the Federal Circuit said a US judge in North Carolina legally erred in finding that resolution of competing allegations of infringement by Ericsson and Lenovo would not be dispositive of concurrent enforcement actions by Ericsson in Brazil and Colombia....
