US appeals court revives Lenovo request for antisuit injunction against Ericsson

( October 24, 2024, 10:10 GMT | Official Statement) -- MLex Summary: Ericsson must defend against efforts by Lenovo to secure antisuit injunctive relief in the US, the US Court of Appeals for the Federal Circuit ruled.  The decision drills down on the meaning of "dispositive," as the term is used at step one of the Microsoft analysis, so-named for the Ninth Circuit’s 2012 ruling in Microsoft v. Motorola.  According to the Federal Circuit, the requirement "can be met even though a foreign antisuit injunction would resolve only a foreign injunction (and not the entire foreign proceeding), and even though the relevant resolution depends on the potential that one party’s view of the facts or law prevails in the domestic suit." At issue are injunctions secured by Ericsson against Lenovo in Colombia and Brazil....
