Samsung, Broadcom debate whether discovery should be stayed until motion to dismiss ruling in US antitrust case

( October 22, 2024, 23:09 GMT | Official Statement) -- MLex Summary: Samsung and Broadcom disagree over whether discovery should be stayed until a US court rules on Broadcom's motion to dismiss allegations it monopolized markets for critical components used for smartphones and tablets, according to a joint discovery letter brief to US Magistrate Judge Laurel Beeler. Samsung, which filed the lawsuit in July, said Broadcom has not come close to showing it is likely to prevail on its motion to dismiss, much less that the complaint is frivolous. Samsung also said that at this initial stage in the litigation, it intends to seek only limited discovery — "the documents already produced by Broadcom in connection with governmental antitrust investigations of the conduct alleged in the Complaint." Broadcom, meanwhile, asserted that Samsung has alleged "implausible and meritless claims of exclusive dealing, tying and monopolization." Noting that discovery in antitrust cases is notoriously expensive and burdensome, Broadcom said its motion to dismiss would dispose of Samsung's case entirely.  See document below. ...
