Law firm Lerner & Rowe's trademark claims against Accident Law Group fail, US Ninth Circuit affirms

( October 22, 2024, 10:10 GMT | Official Statement) -- MLex Summary: Brown, Engstrand & Shely LLC, doing business as the Accident Law Group, prevailed before the US Court of Appeals for the Ninth Circuit on trademark infringement claims by Lerner & Rowe PC, a competing personal injury law firm.  At issue in the case is ALG's use of "Lerner & Rowe" as a keyword in the Google Ads online advertising platform.  According to the panel, the use is unlikely to cause consumer confusion, despite 236 instances of actual confusion documented in the case.See document below....
