Energera exhausted patent rights in covenant not to sue Fuel Automation Station, US appeals court affirms
( October 21, 2024, 10:10 GMT | Official Statement) -- MLex Summary: An infringement lawsuit by Energera against a lessee of fuel delivery equipment manufactured by Fuel Automation Station is foreclosed by the doctrine of patent exhaustion, according to the US Court of Appeals for the Tenth Circuit. In the same ruling, the panel said that the covenant not to sue between Energera and Fuel Automation Station encompasses Energera's Canadian patent, to which three US patents claim priority.
