Capital One opposes plaintiffs motion for partial summary judgment for breach of contract

( August 2, 2021, 22:31 GMT | Official Statement) -- MLex Summary: Attorneys for Capital One oppose a motion from plaintiffs in a putative class action lawsuit over a 2019 data breach affecting 98 million individuals seeking partial summary judgment for breach of contract. "Federal law, including the Gramm-Leach-Bliley Act (“GLBA”), contemplates that banks will experience data breaches," counsel for Capital One wrote. "If Plaintiffs’ theory on their breach of contract claim were correct, every bank subject to the GLBA that suffers a data breach would be liable to every person to whom it issues a privacy notice, regardless of whether that person ever read the required regulatory privacy notice or even knew the bank had a written information security program."
