Google seeks dismissal of amended US claims under Illinois privacy law involving educational tools

The online collection of children's personal information is federally regulated by the Children’s Online Privacy Protection Act, which preempts state laws, including BIPA, that treat the same conduct differently, Google said. "COPPA also implicitly preempts BIPA because allowing Plaintiffs to privately enforce their BIPA claim would upset the carefully balanced enforcement framework enacted by Congress," Google said.
