China issues guidelines on notice, consent in personal-information processing

( May 23, 2023, 09:34 GMT | Official Statement) -- MLex Summary: China's national standardization administration has issued guidelines setting out principles, measures, and procedures for personal-data handlers when informing personal-data subjects and seeking their consent before data processing activities. Set to take effect on Dec. 1, the guidelines clarified that using Big Data and artificial intelligence technology to analyze, relate and generate personal information is categorized as the collection of personal information, which is subject to the obligation of informing data subjects. The guidelines also stipulate the principle of seeking explicit consent from data subjects but allows for presumed consent based on individuals’ practices while placing limitations on applicable conditions. They also provide guidance on how to inform data subjects and seek their consent in 13 typical scenarios including app services, processing personal information of a minor under 14, personalized recommendations, Internet finance and online shopping.
