Solar safeguards suit not affected by US court backing of Trump-era national security tariff hikes, firms say

( July 20, 2021, 15:57 GMT | Official Statement) -- MLex Summary: The Federal Circuit's decision last week to uphold the Trump administration's tariff hike on only steel imports from Turkey has no relevance to Invenergy Renewables and other solar panel importers' Administrative Procedure Act claims against the safeguard tariffs on bifacial solar panels, plaintiffs said in a US Court of International Trade filing. The president delegated no authority to withdraw an exclusion from the safeguard tariffs and reimpose the measures to the Office of the US Trade Representative, the filing said. "The President only delegated to USTR the authority to issue procedures for, and then grant or deny, requests for exclusion of particular products from the safeguard measure established by Proclamation 9693," plaintiffs said. See document below....
