EU guidance on farming exemptions from competition law welcomed by Dutch agency

( May 26, 2023, 10:54 GMT | Official Statement) -- MLex Summary: Draft EU guidelines on how farmers can cooperate under a new exemption from competition rules in the bloc’s reformed Common Agricultural Policy have been welcomed by the Dutch competition authority. But the European Commission must clarify what it means when it says an agreement must be “indispensable” to qualify for the exemption, in order to avoid confusion with parallel guidance on how companies can cooperate legally on sustainable initiatives, the Authority for Consumers and Markets said. The ACM also wants the EU executive to make clear it will only intervene against agricultural agreements in “exceptional cases” to avoid unnecessary deterrence, it said in comments on the draft guidelines published today.The ACM's response to the European Commission's consultation on the guidance is attached....
