Mastercard, Merricks fail in bid to appeal mass claim pre-trial issues ruling from UK CAT

( May 25, 2023, 13:07 GMT | Official Statement) -- MLex Summary: Mastercard and class representative Walter Merricks have failed in their bid to appeal a ruling which saw the UK mass claimant's arguments succeed in narrowed-down preliminary issues ahead of a trial for damages over inflated payment card fees. The litigants disputed certain matters leading up to the trial. The Competition Appeal Tribunal clarified the appropriate law and effect of competition rules for determining cut-off dates, and also ruled that Mastercard was not entitled to argue a counterfactual based on "alternative" fees that would not have been found to be illegal.Ruling attached....
