Fachverband Spielhallen had argued that the lower court wrongly concluded that the measures didn't grant an economic advantage. In today's opinion prepared for the bloc's top court, Advocate General Priit Pikamäe recommended that the 2021 EU General Court order, which fully rejected the applicant's legal challenge, be annulled and that case be referred back to the lower court.
