Behavioral promises granting access to tech or assets can address merger concerns, Vestager says

( May 25, 2023, 08:07 GMT | Official Statement) -- MLex Summary: The EU’s competition boss Margrethe Vestager said that the bloc’s merger regulator has a strong preference for structural remedies, which have formed the basis for 80 percent of conditional clearances in the past five years. “But the nature of merger control is that it requires a case-specific assessment,” therefore some behavioral remedies can address the European Commission’s concerns, she said at a conference today. “Generally speaking, those solutions consist of granting access to a technology or an asset.” Vestager cited as examples the approval for Microsoft’s acquisition of Activision Blizzard, and the approval for Orange’s Voo takeover.The speech follows....
