( November 15, 2022, 22:31 GMT | Official Statement) -- MLex Summary: StarKist filed a reply in support of its motion for judgment to limit its liability in US price-fixing litigation over packaged tuna, saying direct action plaintiffs are foreclosed from arguing that it is liable for Bumble Bee and Chicken of the Sea’s conduct before it joined the alleged conspiracy. It said that plaintiffs can’t pursue joint and several liability after alleging StarKist engaged in the agreements directly. “This alone is fatal to DAPs’ position, especially where DAPs alleged that other Defendants joined an ongoing conspiracy with knowledge.”See document below. ...
