T-Mobile, Softbank cite DC circuit ruling regarding costs of breakup in Meta case
( May 16, 2023, 22:56 GMT | Official Statement) -- MLex Summary: Defendants T-Mobile US and SoftBank Group told a US federal judge that the appeals court ruling in a case brought by state attorneys general against Meta for allegedly monopolizing the social networking market supports the defense's arguments that the laches defense bars the plaintiffs’ claim for injunctive relief. The D.C. Circuit’s decision in New York v. Meta Platforms in April 2023 "actually supports Defendants’ arguments that both prongs of the laches defense — undue delay and prejudice — are met here," they said in a filing. The DC appeals court pointed specifically to the harm arising from breaking up a merged entity, the defendants said.See attached document...
