Blue Cross Blue Shield wrongly granted exemption in Florida rival's antitrust suit, DOJ says

( January 6, 2020, 20:00 GMT | Official Statement) -- MLex Summary: Blue Cross Blue Shield of Florida wrongly escaped an antitrust suit filed by rival Oscar Insurance Co. of Florida in using immunity under the McCarran-Ferguson Act, the US Justice Department said in a brief supporting Oscar at the US Court of Appeals for the Eleventh Circuit. The law limits antitrust liability for the "business of insurance," but the DOJ said the lower court "disregarded the Supreme Court’s instruction that the exemption 'must be construed narrowly.'”See document below....
