Intercontinental Exchange, Black Knight's constitutional defenses should be struck, US FTC tells court
( May 16, 2023, 23:06 GMT | Official Statement) -- MLex Summary: Intercontinental Exchange and Black Knight's affirmative defenses, which allege that the US Federal Trade Commission's administrative law proceeding is unconstitutional, should be struck, attorneys for the US Federal Trade Commission urged a California federal court today. The FTC pointed to the defendants' admission at a pre-trial hearing last week that the claims could "trail" the antitrust matters at-hand and said that was evidence the defendants agreed the constitutional claims are not necessary to resolving the preliminary injunction. The constitutional defenses were also "immaterial and impertinent" and "consist of barebones assertions," the FTC said. A hearing on the motion-to-strike will be held June 22.
