MarketDial co-founder, ex-McKinsey advisor, prevail in trade secret case filed by former McKinsey client

( August 12, 2024, 10:10 GMT | Official Statement) -- MLex Summary: MarketDial, founded in 2016 by former McKinsey advisor John Stoddard, won a summary judgment on allegations its business model is based on information stolen from former McKinsey client Applied Predictive Technologies, or APT. A US judge said that APT, maker of the “Test & Learn” analytics software program which was acquired by Mastercard for $600 million in 2015, failed to establish the information at issue rises to the level of a trade secret. “A plaintiff must pin down its alleged secrets by identifying what’s known or readily ascertainable by those in the industry,” US District Judge Jill N. Parrish of the District of Utah explained, citing the US Court of Appeals for the Seventh Circuit’s 2002 decision in IDX v. Epic. Because APT failed to identify, with adequate specificity, the information Stoddard allegedly misappropriated when forming MarketDial with co-defendant Morgan Davis, the judge deemed summary judgment warranted.See document below....
