Google wins dismissal of private US antitrust search claims, but judge grants leave to amend following DOJ decision

( August 9, 2024, 23:57 GMT | Official Statement) -- MLex Summary: Google has won dismissal of private antitrust litigation alleging its default contracts that exclude competitors monopolize the search market, violating Section 2 of the Sherman Act.  But US District Judge Rita Lin in San Francisco left a window open for the plaintiffs in light of the US Department of Justice's recent win in its search case against Google. Lin wrote that while "Google is correct that the Second Amended Complaint does not allege sufficient facts from which antitrust injury could plausibly be inferred," she rejected Google's argument that the plaintiffs could never construct an "alternate universe demonstrating what the market would have produced for consumers absent the alleged anticompetitive conduct." Lin granted Google's motion-to-dismiss but gave plaintiff Mary Katherine Arcell leave to amend her claims.See attached document....
