( May 7, 2010, 22:58 GMT | Official Statement) -- MLex Summary: The indirect purchaser plaintiffs have filed their response brief in Agrium's appeal of a lower court decision not to dismiss claims against it as barred under the Foreign Trade Antitrust Improvement Act. They argue that the district court properly determined that it had jurisdiction under the direct effects exception of the FTAIA. They also argue that they present grounds from which it is plausible to infer an illegal agreement, and that those grounds are more plausible than "those which the Supreme Court found 'came close' to doing so in Twombly."Please see attached document...
