Par/Paddock maintain that their settlement with Solvay is immune from antitrust scrutiny under the Noerr-Pennington doctrine, and that the FTC has not demonstrated any plausible harm from their agreement not to enter the market at the same time as Watson because they would be unable to do so by law.See brief below....
