U.S. District Court: Northern District of Georgia - Federal Trade Commission v. Watson Pharmaceuticals et al [order]

( February 22, 2010, 23:00 GMT | Official Statement) -- MLex Summary: U.S. District Court Judge Thomas W. Thrash, Jr. granted the defendants' motions to dismiss the Federal Trade Commission and indirect purchasers' pay-for-delay claims over the drug AndroGel. He ruled that the plaintiffs did not demonstrate that the settlement agreements exceeded the scope of the patent involved, or that the litigation involved was a sham. He also dismissed most of the direct purchasers' claims, but determined that the purchasers' allegations regarding the written description of the patent cannot be resolved at the pleading stage.Please see attached document...
