US DOJ secures criminal guilty plea in Section 2 monopolization case

By Michael Acton ( October 31, 2022, 18:33 GMT | Insight) -- The US Department of Justice has secured a guilty plea for criminal attempted monopolization from a Montana paving and asphalt contractor – the first such case to be successfully litigated by the DOJ's antitrust division in decades. The DOJ announced today that company president Nathan Nephi Zito pleaded guilty to approaching a competitor with an agreement to allocate regional markets, with Zito’s company offering to withdraw from highway crack-sealing projects in South Dakota and Nebraska if the competitor withdrew from projects in Montana and Wyoming.
